We believe our brand identity is critical to the success of our business. If we are unable to use any of our trademarks or to protect our trade secrets, our sales and our results of operations will be adversely affected. We are vulnerable to fluctuations in the cost, availability and quality of our ingredients. Adverse publicity, particularly about health concerns, could reduce our sales and adversely affect results of operations. Government regulation of our business could adversely affect the results of our operations. We experienced a number of franchise store closures since 2002. If this trend continues, our financial position and results of operations could be adversely affected. The Indenture imposes significant operating and financial restrictions, which may prevent us from pursuing certain business opportunities and taking certain actions.
