Our potential inability to implement our restructuring plan, or to realize its anticipated benefits, could adversely affect our results of operations and financial condition. Terms of collective bargaining agreements and labor disruptions could adversely impact our results of operations. The Chapter 11 process and the DIP Facility impose restrictions on the conduct of our business. Our financial statements assume we can continue as a going concern . Future cash contribution obligations to the American Bakers Association Retirement Plan, or the ABA Plan, are expected to significantly exceed previous contributions to the ABA Plan. We rely on the value of our brands, and the costs of maintaining and enhancing the awareness of our brands are increasing. Economic downturns could cause consumers to shift their food purchases from our branded products to lower priced items. Inability to anticipate changes in consumer preferences may result in decreased demand for products. Our intellectual property rights are valuable and any inability to protect them could dilute our brand image and adversely affect our business. Further consolidation in the retail food industry may adversely impact profitability. Future product recalls or safety concerns could adversely impact our business and financial condition and results of operations. Costs associated with environmental compliance and remediation could adversely impact our operations.
